Terms of service
These terms cover one service: ordering an Ontario 3-year driver record from ServiceOntario on your behalf. They are written to be read.
1. Who we are
DriversAbstract is a trading name of Q-Flow, at 308 Northglen Blvd, Bowmanville, ON L1C 7G5. Contact: [email protected], +17812197658, Mon-Fri 9am-5pm ET.
We are a private company. We are not a government agency, we are not affiliated with or endorsed by ServiceOntario or the Ministry of Transportation, and no government has authorised, approved, accredited or appointed us. We are specifically not an MTO “authorized requestor”, which is a status held under a signed contract with the ministry. We do not hold one.
2. What we do, and what we do not
We take the driver's licence number you give us, check it against the format the ministry requires, submit a request for the 3-year uncertified driver record, and pay the ministry's $12.00 fee out of our own account. ServiceOntario issues the record and emails it to you directly.
We do not:
- issue, hold, compose or correct driving records — only the Ministry of Transportation does that;
- receive, hold or post anything physical, in either direction;
- log in to any government system as you, or sign anything as you;
- sell any record that includes an address, or a driver's licence history, because the ministry restricts both and we are not permitted to obtain them;
- sell the certified record with the ministry's seal;
- promise to be faster than the ministry. It issues this record immediately either way.
3. Who may order
ServiceOntario states that anyone can order a 3-year driver record if they provide a driver's licence number. That is the ministry's rule and it is why this service exists in Ontario and not in provinces that require a witnessed consent form.
By placing an order you confirm that the information you give us is true and that you are entitled to make the request. You must not use this service to obtain a record for an unlawful purpose, including harassment or identifying or locating a person against their wishes. We may refuse or cancel any order at our discretion and refund it.
4. Where we cannot serve you
We do not accept orders from customers in Quebec. Quebec's Law 25 attaches obligations to the personal information of a person in Quebec that we are not currently set up to meet, and we would rather refuse than half-meet them.
5. Price and payment
$40.00 CAD in total for one record: $12.00 is the ministry's fee, $28.00 is ours. That is the whole price. Nothing is added at checkout, there is no subscription, and there is no renewal.
You are charged once, by us. Your card details never reach the ministry and never reach us — payment runs on Stripe's hosted checkout page, and we receive only a confirmation that it succeeded.
We buy the ministry's fee as our own cost of doing the job. We are not collecting it on the ministry's behalf, we are not its agent, and it is not payable through us.
6. Refunds
Full refund of everything you paid, at any time before we submit your request. After submission the ministry's fee is spent and is not returnable. If the failure is ours you get everything back including the ministry's fee. The full policy is here and you accept it at checkout.
7. What we are responsible for, and what we are not
We are responsible for submitting the request you paid for, accurately, and for paying the ministry's fee. If we fail at either, the remedy is in the refund policy.
We are not responsible for what the record says, for the ministry's processing, for a record that returns no result because the licence number you gave was not yours, or for a third party deciding your record is unsatisfactory. Those are outside anything we control and outside anything the fee buys.
To the extent the law allows, our total liability for any order is limited to what you paid us for it. Nothing here limits liability that cannot lawfully be limited, including for fraud, and nothing here limits your rights under Ontario consumer protection legislation.
8. Estimates are estimates
ServiceOntario issues this record immediately, which is why we quote same-day delivery. It is the ministry's timing, not a promise from us, and we cannot compel it. A delay at the ministry is not a breach of these terms.
9. Your data
We collect the minimum the ministry needs: a driver's licence number, and an email address to reach you. It is encrypted at rest, deleted on a 30-day clock, and stored and processed in the United States, where it may be accessed by courts, law enforcement and national security authorities under US law. The privacy policy sets out all of it.
10. Changing these terms
The terms that apply to your order are the ones published when you placed it. We may change them for future orders; we will not change them retroactively.
11. Law and complaints
If something has gone wrong, email [email protected] first. We would rather fix it than argue about it.
You can also complain about a business to the Competition Bureau of Canada, which is the body that polices private companies giving the impression they are the government. We publish that here on purpose.
